The wedding invitations have been printed and mailed to the guests, and with the fine details looked into, you can now relax and look forward to the event. However, days before the wedding, what if the chosen venue gets foreclosed? Unfortunately, this is the reality with the recession and foreclosures on the rise. This is why you should choose a venue judiciously.
Before Contracting the Location
While choosing a wedding venue, you should ask a few questions to your representative to prevent a foreclosed location days before the event. On your first meeting with the event coordinator, you should ask if the credit standing of the business is credible. Is the property in foreclosure? If yes, you should conduct further search because it is unlikely for the business to stay in operation at the period when your event is scheduled. If these questions are not taken by your coordinator, look elsewhere.
Other than finding answers to these questions, you can do an online search or visit the office of the county recorder to check the public records. It will tell you whether any payments are delinquent, or whether the property is foreclosed. Verify the property tax records. If the owner owes tax, they have delinquent mortgage payments too.
In case you are a victim of a foreclosed wedding venue, you may convict the owner of breach of contract. However, before following up with the claim, you must alleviate your damages and seek an alternative wedding spot to conduct your celebrations. The damages comprise any added expenditure that you would incur for securing an alternative venue, such as costs of printing fresh wedding invitations and making travel plans at the last minute.
You may even be required to pay added amounts to the vendors for making special arrangements for performing your services in a separate location. If there are extra amounts that are to be paid to the vendor, these can be incorporated within your damages claim against the venue.
Your legal remedies are restricted in case you decide on entering a contract knowing completely that the wedding venue or property is in foreclosure or that it could be foreclosed any time before your wedding date. This is why it is always recommended to contract a destination which is free from foreclosure. Even if the venue has a clean chit, you must review the contract carefully and ensure that it mentions what is to be done with your deposit fee if the business is closed somehow.
